PMX ProMaxima Warranty Disclaimer:

This warranty disclaimer ("Disclaimer") is provided by PMX ProMaxima and applies to all products or services sold or provided by the Company, beyond what is expressly stated in any written warranty or guarantee accompanying the product or service.

• No Additional Warranties: Except as expressly stated in any written warranty or guarantee provided by the Company with the product or service, the Company disclaims all other warranties, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Limitation of Liability: In no event shall the Company be liable for any indirect, consequential, special, incidental, or punitive damages, whether arising in contract, tort (including negligence), or otherwise, even if the Company has been advised of the possibility of such damages.
• Exclusions: This Disclaimer extends to, but is not limited to, damages for loss of profits, revenue, data, use, or other intangible losses, whether or not foreseeable, and regardless of whether the Company has been advised of the possibility of such damages.
• User Responsibility: It is the responsibility of the user or customer to ensure the proper use, installation, and maintenance of the product or service. The Company shall not be held liable for any damage or malfunction caused by improper use, installation, or maintenance.
• Modification or Discontinuation: The Company reserves the right to modify, suspend, or discontinue any product or service, or the terms of this Disclaimer, at any time without prior notice.
• Governing Law: This Disclaimer shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law principles.

By using or purchasing any product or service from the Company, you acknowledge and agree to be bound by the terms of this Disclaimer. If you do not agree with these terms, your sole remedy is to return the product in accordance with the Company's return policy or cease using the service.

THIS WARRANTY IS NON-TRANSFERABLE. It applies only to the original purchaser of the product and/or service, and any attempt to transfer this warranty to another party will render it void. Subsequent owners are not covered by this warranty.

**ADDITIONAL Warranty Disclaimer for Used or "As-Is" Equipment**

This equipment is sold "as-is" without any warranty, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the equipment is with the buyer.

The seller makes no representations or warranties about the condition, functionality, or performance of the equipment. It is the buyer's responsibility to thoroughly inspect the equipment before purchase and satisfy themselves as to its condition.

The seller disclaims any and all warranties regarding the equipment, whether written or oral, including any warranty of title or non-infringement. No advice or information, whether oral or written, obtained by the buyer from the seller shall create any warranty not expressly stated in this disclaimer.

In no event shall the seller be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services, loss of use, data, or profits, or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this equipment, even if advised of the possibility of such damage.

This warranty disclaimer applies to the fullest extent permitted by law. If any provision of this disclaimer is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

By purchasing the equipment, the buyer acknowledges that they have read, understood, and agreed to this warranty disclaimer.
